Short answer
Can a foreign company hire employees in Vietnam without an entity?
Companies from any country can employ people in Vietnam without a Vietnamese entity by using an employer of record. Nhân Kiệt signs the labour contract, runs payroll in dong, pays social insurance and personal income tax, applies for work permits, and charges US$99–199 per employee a month plus VAT, whatever country your company is in. What changes from one home country to another is the tax treaty with Vietnam, how you pay a foreign provider, the time difference and holidays, and — for Korea — a social security agreement that can exempt Korean staff from Vietnamese pension contributions. Vietnam has double tax agreements in force with most countries whose companies hire here; the United States is the main exception, as its 2015 treaty has not entered into force. Nhân Kiệt’s account team works with clients in English, Japanese, Korean and Chinese. The guides below cover each country’s points.
