How it applies

How does the 2027 minimum wage apply?

Articles 3 and 4 of Decree 399/2026/ND-CP set how the region is chosen and how pay is compared with the minimum:

  • Region by place of operation: an employer applies the rate of the area where it operates; a branch in another area applies that area’s rate.
  • Zones across regions: an industrial park, export processing zone, high-tech park or free trade zone spanning areas with different rates applies the highest rate.
  • Renamed or merged areas: a renamed or split area keeps its previous rate; an area formed from areas with different rates applies the highest, until the Government decides otherwise.
  • Monthly pay: the job’s salary for full normal hours must not be below the monthly minimum.
  • Hourly pay: must not be below the hourly minimum.
  • Weekly, daily, piece-rate or lump-sum pay: convert to a monthly figure (weekly pay × 52 ÷ 12, or daily pay × normal working days) or an hourly figure, then compare.

Employer checklist

What should employers do before 1 January 2027?

Article 5(3) of Decree 399/2026/ND-CP requires employers to review labour contracts, collective agreements and internal pay rules. In practice:

  • Raise pay below the new floor from the January 2027 payroll.
  • Keep agreed premiums: terms more favourable to employees, such as at least 7% above the minimum for jobs needing training and at least 5% for heavy or hazardous work, continue unless the parties agree otherwise.
  • Do not cut other entitlements such as overtime, night-work pay and in-kind allowances.
  • Update the insurance salary: social insurance salary cannot be below the new regional minimum. In Region I, the employer’s share of about 23.5% on the floor is ₫1,339,500 a month, ₫91,650 more than in 2026.
  • Check probation and part-time pay: probation pay is at least 85% of the job’s salary; hourly pay in Region I is at least ₫27,400.
